As of March 17, 2026, Bitcoin and 15 other assets have been officially classified as "Digital Commodities".

Goodbye to the Howey Test: These assets are no longer considered securities. Their value depends on supply, demand, and their programmatic system, not on the efforts of third parties.
Clarity of Jurisdiction: The CFTC will supervise spot markets, while the SEC will only maintain authority over assets that continue to be classified as digital securities.
New Taxonomy: Clear rules are established for stablecoins, digital tools, and collectibles.
